Kính gửi tổ chức Front Line Defenders, BTC Hội Nghị Dublin Platform và các tổ chức quốc tế,

Tôi vô cùng cảm ơn truớc sự quan tâm của quý vị đến những nguời đấu tranh cho nhân quyền trong nước Việt Nam mà trong đó có tôi. Tôi cũng cảm ơn sự hết lòng giúp đỡ của quý vị để tôi có thể có mặt tại Dublin từ 14-16 tháng 9, 2011 nhằm để chia sẻ, học hỏi những kinh nghiệm hữu ích cho bản thân.


Tuy nhiên, sáng nay ngày 12.9 trong lúc làm thủ tục để xuất cảnh sang Singapore, tôi đã bị Công an an ninh cửa khầu Nội bài ngăn chặn không cho xuất cảnh với lý do “theo đề nghị của PA83- Công an tỉnh Daklak”, nhưng lý do này được ra sau khi họ có cuộc trao đổi qua điện thọai với nhau. Vì vậy, tôi rất tiếc không thể được tham dự chuơng trình của quý vị.

Bởi lẽ:

Việt nam – đất nuớc của nhiều “chuyện lạ”; mới đây nhà nước đặt ra mục tiêu đến năm 2020 Việt Nam phải có 18-20 ngàn luật sư, bình quân 1luật sư/4.500 dân nhưng từ năm 2007 hàng chục luật sư, luật gia đã bị bắt hay luôn bị chính quyền sách nhiễu dưới nhiều hình thức nhằm cản trở việc Luật sư hành nghề cũng như để trở thành luật sư.
Hầu hết các luật sư nhân quyền đều bị sách nhiễu và cấm đoán ở mức độ đáng báo động. Gần đây nhất là trường hợp của luật gia Tạ Phong Tần – người được biết đến như là nhà báo, blogger dù bà đủ điều kiện hành nghề luật sư tại việt nam nhưng đã bị chính quyền sách nhiễu trong nhiều năm, tịch thu các văn bằng, chứng chỉ và bị bắt vào ngày 6/9/2011. Trước đó thì có Lê Quốc Quân, Nguyễn văn Đài, Lê Công Định, Tiến Sĩ Cù Huy Hà Vũ,... và tôi cũng đã chính thức bị xóa tên khỏi danh sách đòan luật sư vào ngày 12/8/2011.

Qua các động thái trên của nhà nuớc Việt Nam cho chúng ta thấy; Việt Nam không thừa nhận sự tồn tại của LS nhân quyền và nhà nước Việt Nam không thừa nhận tiêu chuẩn mang tính cơ bản chung của Luật sư quốc tế. Nên có thể nói rằng, Luật sư tại Việt Nam chỉ là công cụ để nhà nước đánh bóng nền dân chủ trá hình và Tòa án là nơi nhân danh thứ công lý giả tạo.

Tôi đã tham gia vào nhiều vụ án, tất cả các vụ xét xử các nhà bất đồng chính kiến, dân oan; phán quyết cuối cùng được đưa ra đều không dựa vào kết quả tranh luận tại tòa và ngay từ đầu, cơ quan tố tụng luôn biểu hiện thái độ ngăn cản sự có mặt của Luât sư trong những vụ án này, lạm dụng quy định về an ninh quốc gia Cơ quan công an điều tra không cho phép luật sư tham gia từ giai đọan điều tra. Đến khi kết thúc điều tra thì tòa án gây khó khăn trong việc tiếp cận hồ sơ, tại tòa thì Luật sư bị hạn chế quyền trình bày quan điểm, ý kiến, bị đe dọa trục xuất khỏi tòa.... Tôi đã một lần tỏ thái độ bất hợp tác với tòa nên đã tự rời phòng xử án và một lần bị áp giải khỏi tòa án khi tôi cố thực hiện quyền của người Luật sư theo luật định. Thậm chí, có vụ án, Tòa án thực hiện luôn vai trò của cơ quan công tố một cách rõ ràng như vụ tranh chấp đất đai giữa chính quyền với nhân dân tại Cồn Dầu, Đà Nẵng.

Thật khó để Luật sư nhân quyền hành nghề theo đúng lương tâm và trách nhiệm nghề tại Việt nam vì luôn bị sự cản trở bởi qui định của luật hoặc bởi những mệnh lệnh trái luật và sau đó là thường xuyên “làm việc” với công an an ninh cũng như thường xuyên bị công an theo dỏi, điều tra (không chỉ đối với riêng cá nhân luật sư đó mà cả gia đình và các quan hệ xã hội khác) nhằm tạo ra một sức ép để buộc Luật sư hành nghề đúng kiểu... Việt Nam.

Bất tuân, phản kháng trước sự can thiệp thô bạo của nhà nước đối với nghề nghiệp mang tính xã hội, Luật sư, luật gia chỉ có hai lựa chọn: làm công việc khác (do bị tước bằng) hoặc đi tù vì tội “chống nhà nước”.

Vì vậy, với quốc tế tôi mong muốn quý vị hãy lên tiếng một cách mạnh mẽ và tỏ thái độ dứt khóat trước việc vi phạm một cách nghiêm trọng pháp luật quốc tế mà VN đã tham gia, kí kết là thành viên. Các quốc gia đã và đang tài trợ cho Việt Nam thực hiện các dự án cải cách tư pháp, phát triễn đội ngủ Luật sư nên xem xét lại. Tôi đã từng được tham dự một lớp tập huấn cho Luật sư do Việt Nam tổ chức và cảm nhận của tôi là người ta muốn sử dụng để ...hết số tiền mà nước ngòai tài trợ. Tôi thật sự thất vọng trước trình trạng đàn áp nhân quyền của VN ngày càng cao và nạn sử dụng các nguồn tài trợ kém hiệu quả.

To Front Line Defenders, the organizers of the Sixth Dublin Platform for Human Rights Defenders and all international NGOs:

I am immensely grateful for the attention and concern shown for the human rights activists in Vietnam, including myself. I sincerely thank you for all your efforts in inviting me to the Dublin Platform this September 14-16, 2011 so that I may share my experiences as well as have a chance to learn from others.

Unfortunately, this morning when I arrived at Noi Bai airport in Hanoi to head for Singapore, I was detained by the airport police and was told that I was not allowed to leave the country. Their order came “at the request of the PA83-Daklak Police Department.” Besides that statement from airport police, there was no further explanation. I am very disappointed that I could not make it to the Dublin Platform and be part of your wonderful program this year.

As you know, in Vietnam, anything can happen. Injustices that cannot happen in a just and democratic society is the norm here. Just recently, the state set a new goal to have 18-20,000 lawyers by 2020, one lawyer for every 45,000 citizen. However, since 2007, dozens of lawyers and legal scholars have been systemically arrested or harassed, hindering their legal obligations to their clients and their ability to practice.

The majority of the human rights lawyers are being harassed and threatened at an alarming rate. The most recent case is attorney Ta Phong Tan, also a blogger and writer, who rightfully should still be a practicing lawyer. Miss Ta Phong Tan was harassed, threatened, intimidated, her personal belongings confiscated, credentials revoked and was recently arrested on September 6, 2011. Before Miss Ta Phong Tan there was also Le Quoc Quan, Nguyen Van Dai, Le Cong Dinh, and Cu Huy Ha Vu and I myself was officially disbarred on August 12, 2011.

Through these actions, the Vietnamese government is attempting to stamp out this class of human right lawyers. Vietnam, at present, does not uphold international standards regarding due process or even its own code of law. Being a lawyer is like being a pawn for the government, to be used as a front to the international community, as a semblance of a respectful legal system and any regard for human rights.

I have been involved in many trials, cases involving democracy activists and aggrieved citizens. The outcomes and the sentences had nothing to do with the evidence and arguments presented. Miscarriages of justice is evident as the court outright bars and dismisses lawyers from many of these trials.

The pretext was always under the guise of “national security” so in all of the cases, the investigative branch would not allow the accused to have the consult of a lawyer from the beginning and even when the investigation had finished, the power that be always made it difficult if not impossible for a lawyer to fully exercise his duty to his client. The government did not fully disclose all materials, files during the discovery process. Even at the trial itself, lawyers were gagged and forbidden from fully representing the clients and in many cases were thrown out of court, all together. I once spoke out and objected to such hand-binding from the court in a case and was physically manhandled and thrown out of court because I stated that I had a legal and ethical responsibility to defend and the court is not letting me do my job.

I spoke up in court about the biases of the court and was physically removed. During the Con Dau and Da Nang trials, the court itself acted as the enforcer in the land dispute between the government and those who brought the suit against the government.

It is very difficult if not impossible for a lawyer to ethically fulfill his professional duties due to the barrage of regulations, mandates, and outright unlawful directives handed down from the court and all its legal arms. Lawyers are harassed, intimidated, questioned, put under around-the-clock surveillance and threatened by the police and these methods not only extend to the lawyers involved but also to their family, friends, and social network. This ever present threat creates a pressure so that lawyers had to bend. That is how it is in Vietnam.

Regardless of the protests against the treatment of human rights lawyers, attorneys have only two options: quit and find another profession (because the likelihood of being disbarred is imminent) or go to jail “for opposing the government.” This is why I urge the international community and particularly those attending the Dublin Platform to speak out about the blatant abuse and violation of law, human rights violations and the hijacking of the justice system that is being carried out in Vietnam. The government of Vietnam is violating international accords to which it had entered as a participant of the larger International Community.

Countries that provide aid to Vietnam for the purpose of legal reform and it reach its goal to produce lawyers need to re-examine the government’s effort. Once, I attended a “refresher” course organized by the government and funded by various international donors. I was disappointed and felt as though these “refresher,” “enrichment” classes was just a way to spend the funds because they had to. I am disappointed and appalled at the blatant violation of human rights in Vietnam at such an alarming rate; all the money of the world could not help Vietnam reform its legal system.
