Ngày
06 tháng 9 năm 2013, Viện Kiểm sát Nhân dân TP. Tân An công bố bản cáo trạng đối
với Đinh Nhật Uy và sẽ đưa Đinh Nhật Uy ra xét xử vào ngày 29 tháng 10 năm
2013. Mạng lưới Blogger Việt Nam (MLBVN) có những nhận định
về bản cáo trạng cũng như về phiên tòa sắp sửa diễn ra như sau:
1. Công dân Đinh Nhật
Uy đã bị truy tố dựa vào một điều khoản mà nội dung "Lợi dụng
các quyền tự do dân chủ xâm phạm lợi ích của Nhà nước, quyền, lợi ích hợp pháp
của tổ chức, công dân" đã:

Vi phạm Điều 19 của Tuyên ngôn Quốc tế Nhân quyền: “Mọi người đều
có quyền tự do tư tưởng và biểu đạt. Quyền này bao gồm sự tự do tư tưởng mà
không bị cản trở, được tự do tìm kiếm, thu nhận và quảng bá tin tức và ý kiến
qua mọi phương tiện truyền thông bất kể biên giới”.

Cho phép sự suy diễn tùy tiện, không dựa vào bất kỳ một nền tảng pháp lý, quy định
cụ thể nào, với phạm vi áp dụng bao trùm lên bất kỳ sinh hoạt nào của công dân.

Hình thành một khung cảnh pháp lý trong đó chủ thể bị "xâm phạm lợi
ích", tức nhà nước, vừa là bên điều tra, buộc tội (cơ quan điều
tra, Viện Kiểm sát Nhân dân), vừa có thẩm quyền xét xử (Tòa án), trong khi
chính nhà nước và đảng cầm quyền lại liên tục phủ nhận mô hình nhà nước tam quyền
phân lập, duy trì sự lãnh đạo tuyệt đối của đảng trong mọi giai đoạn tố tụng, đồng
nghĩa với việc phủ nhận sự độc lập của Tòa án khi tiến hành xét xử.
Một
cáo trạng và phiên tòa phán xét dựa trên một điều khoản vi phạm những quy ước
quốc tế, đi ngược lại những nguyên lý căn bản của pháp luật, thì không thể kết
án bất kỳ một công dân nào. Đối với MLBVN, ngay từ đầu và cả sau phiên tòa xử,
Đinh Nhật Uy luôn luôn vô tội.
2. Nếu Tòa án Nhân
dân Tân An và hệ thống pháp lý vẫn kết án Đinh Nhật Uy có tội, với nguyên tắc mọi
công dân, bao gồm cả đảng viên lẫn lãnh đạo đảng, đều bình đẳng trước pháp luật
theo điều 52 Hiến pháp, Mạng lưới Blogger Việt Nam đề nghị:

Viện Kiểm sát Nhân dân truy tố công dân Trương Tấn Sang đã "Lợi dụng
các quyền tự do dân chủ xâm phạm lợi ích của Nhà nước" trong việc mạ lỵ
Thủ tướng Chính phủ Nguyễn Tấn Dũng là "đồng chí X", gọi đảng cầm quyền
là một bầy sâu...

Viện Kiểm sát Nhân dân truy tố công dân Nguyễn Phú Trọng đã "Lợi dụng
các quyền tự do dân chủ xâm phạm lợi ích hợp pháp của tổ chức" trong việc vu khống
Đảng Cộng sản Việt Nam: "Tham nhũng lớn cũng có, tham nhũng nhỏ cũng nhiều
như gãi ghẻ, rất khó chịu. Chạy chỗ nào cũng thấy phải có tiền...", trong
khi cho đến nay vẫn không có một tập thể lớn nào bị truy tố và chứng minh bởi
luật pháp là họ có tội tham nhũng.

Viện Kiểm sát Nhân dân truy tố công dân Nguyễn Sinh Hùng đã "Lợi dụng
các quyền tự do dân chủ xâm phạm lợi ích của nhà nước": Ông Hùng nói
"Tham nhũng đã len lỏi vào ngay cả lực lượng chống tham nhũng của chúng
ta...", trong khi trên thực tế không một ai trong lực lượng chống tham
nhũng bị pháp luật kết án.

Viện Kiểm sát Nhân dân truy tố tất cả các nhà báo, phóng viên đã "Lợi dụng
các quyền tự do dân chủ xâm phạm lợi ích của Nhà nước, quyền, lợi ích hợp pháp
của tổ chức, công dân" khi xuyên tạc,
vu khống các tập đoàn kinh tế nhà nước, kết án công dân Việt Nam khi chưa có
phán quyết có tội của tòa án, chỉ trích và nói xấu lãnh đạo nhà nước.

Viện Kiểm sát Nhân dân truy tố tất cả chúng tôi, những blogger Việt Nam đã có
những phát biểu, bài viết có nội dung tương tự như những gì Đinh Nhật Uy đã viết,
những công dân Việt Nam đã công khai mặc áo thun Hoàng Sa-Trường
Sa-Việt Nam; No to U-Line!
Yes to UNCLOS!, Xóa “đường lưỡi
bò” bảo vệ biển đảo Việt Nam... mà hiện đang được xem là những tang
chứng về việc Đinh Nhật Uy phạm tội.
3. Chúng tôi kêu gọi
Hội đồng Nhân quyền Liên Hiệp Quốc coi sự kiện truy tố và xét xử Đinh Nhật Uy
là một trong những vấn đề cần xem xét trong việc Việt Nam ứng cử để trở thành
thành viên của Hội đồng.

Declaration by the Network of
Vietnamese Bloggers on the prosecution and trial of Đinh Nhật Uy
Whereas
the People's Procuratorate of Tân An City on September 6, 2013 released the
indictment against Đinh Nhật Uy and is going to put Uy on trial on October 29,
2013, the Network of Vietnamese Bloggers asserts and declares the following, on
the prosecution as well as the forthcoming trial of Uy:
1. Citizen Đinh Nhật
Uy is being charged under a law which, by providing for punishment upon “abusing
democratic freedoms to infringe upon the interests of the State, the legitimate
rights and interests of organizations and/or citizens”, has:
-
violated Article 19 of the Universal Declaration of Human Rights, which
stipulates that “Everyone has the right to
freedom of opinion and expression. This right includes freedom to hold opinions
without interference and to seek, receive and impart information and ideas
through any media and regardless of frontiers”;
-
allowed an arbitrary interpretation which is not based on any legal framework
or any specific regulation and can be applied to any civic action;
-
created a legal context in which the alleged victim whose interest is
“trespassed on”, ie. the State, is acting as the investigator and the
prosecutor (the investigating body and the People's Procuratorate), as well as
the judge and jury (as the court), while at the same time this same State and
the ruling Party have always rejected principles of separation of power and
maintained the monopoly of the Communist Party dictating every stage of the
legal proceeding process. This means no independent judiciary during the trial
process.
Such
a prosecution and trial based on a law that violates international obligations
and runs counter to basic principles of law cannot legitimately convict any citizen. The Network of
Vietnamese Bloggers, before, during and after the trial, holds the opinion that
Đinh Nhật Uy is innocent.
2. If the Tan An
People's Court and the entire legal system of Vietnam keep convicting Uy, then
the Network of Vietnamese Bloggers, based on the principle that all citizens,
including both leaders and members of the Party, are equal before the law,
according to Article 52 of the Vietnamese
Constitution,
requests:

The People's Procuratorate to charge citizen Trương Tấn Sang, who has “abused
democratic freedoms to infringe upon the interests of the State” by offensively
calling Prime Minister Nguyễn Tấn Dũng as “comrade X” and labelling the ruling
Party as “a bunch of insects.”

The People's Procuratorate to charge citizen Nguyễn Phú Trọng, who has “abused
democratic freedoms to infringe upon the interests of the State” by defaming the
Vietnamese Communist Party, “There are cases of macro corruption; there are
also cases of petty corruption which are as annoying as scabies. No matter
where you go, you must have money on you,” although to date there has not any
organization to be charged and proved guilty of corruption.

The People's Procuratorate to charge citizen Nguyễn Sinh Hùng, who has “abused
democratic freedoms to infringe upon the interests of the State” by saying,
“Corruption has penetrated into even our anti-corruption forces,” despite the
fact that there has not been anyone in the anti-corruption forces convicted of
corruption.

The People's Procuratorate to charge all journalists who have “abused
democratic freedoms to infringe upon the interests of the State, the legitimate
rights and interests of organizations and/or individuals” by committing
libel against state owned corporations, convicting Vietnamese citizens even
when there has not yet been any verdict by the court, criticizing and smearing
the State's leaders.

The People's Procuratorate to charge all of us, Vietnamese bloggers who have
raised opinions and published articles similar to what Đinh Nhật Uy wrote,
Vietnamese bloggers who publicly wear advocacy T-shirts, “Paracels-Spratlys-Vietnam”;
“No to U-Line! Yes to UNCLOS”, “Abolish 'the ox-tongue line', defend Vietnam's
islands and seas”,
all of which have been alleged as evidence of Đinh Nhật Uy's wrong-doings.
3. We urge the
United Nations Human Rights Council to deem the prosecution and trial of Đinh
Nhật Uy as one of the issues that need considering with regard to Vietnam's
candidacy for membership in the United Nations Human Rights Council.
