bố về việc chính quyền ngăn chặn công dân Việt Nam
đến
tham dự các cuộc trao đổi về Quyền Con Người
Ngày 20/6/2014, tại phiên họp
thông qua báo cáo Kiểm điểm Định kỳ Phổ quát (UPR) chu kỳ 2, dưới sự chủ tọa
của Hội đồng Nhân quyền Liên Hiệp Quốc, tại Genève, chính phủ Việt Nam đã
thông báo chấp nhận 182 khuyến nghị trên 227 khuyến nghị do các nước đề xuất.
Trong số các khuyến nghị được chấp thuận, có “dành không gian cho truyền
thông phi nhà nước, và làm cho các điều 79, 88 và 258 của Luật Hình Sự cụ thể
và nhất quán hơn với các nghĩa vụ nhân quyền quốc tế về tự do biểu đạt” của
Úc.
Trước sự kiện này, chính phủ Úc đã cùng với Liên minh châu Âu, Đại sứ quán Canada,
New
Zealand, Na Uy và Thụy Sĩ đứng ra tổ chức buổi Hội thảo: Truyền thông Phi
Nhà nước ở Việt Nam trong thời kỳ hiện nay vào ngày 30/7/2014 tại Đại Sứ Quán
Úc, Hà Nội.
Cũng trong thời gian này, ông Heiner Bielefeldt, báo cáo viên đặc biệt của Liên
Hợp Quốc, đã đến thăm Việt Nam từ ngày 21 đến 31.07.2014 theo lời mời của
chính phủ Việt Nam với mục đích tìm hiểu thêm về việc tôn trọng và bảo hộ
quyền tự do tôn giáo hay tín ngưỡng và những trở ngại đối với quyền cơ bản
này tại Việt Nam.
Cả hai sự kiện đều được tổ chức công khai, là cơ hội để chính phủ Việt Nam chứng
minh với quốc tế rằng Việt Nam sẵn sàng thực thi các nghĩa vụ và cam kết của
một quốc gia thành viên Hội Đồng Nhân Quyền Liên Hiệp Quốc.
Thế nhưng, thay vì tạo một môi trường thuận lợi như đã hứa hẹn chính thức với
chính phủ các nước, chính quyền Việt Nam lại đã một lần nữa sử dụng biện pháp
bao vây, quấy nhiễu, đe dọa và bắt giữ vô cớ nhằm ngăn trở, cô lập công dân
Việt Nam đến tham dự các cuộc trao đổi này. Cụ thể, các blogger, nhà báo độc
lập, nhà hoạt động dân sự như bác sĩ Nguyễn Đan Quế, cựu tù nhân lương tâm
Phạm Bá Hải, bà Dương Thị Tân, nhà báo Phạm Chí Dũng, mục sư Nguyễn Mạnh
Hùng, mục sư Nguyễn Hoàng Hoa, Hội trưởng PGHH Lê Quang Liêm, blogger Nguyễn
Ngọc Như Quỳnh, Trần Thị Nga, Huỳnh Phương Ngọc, Phạm Thanh Nghiên, v.v… đã
bị gây khó dễ trước và sau khi tham gia các sự kiện này.
Trong bản báo cáo kết quả sơ bộ chuyến viếng thăm của mình, chính ông Heiner Bielefeldt
cho biết như sau: "Dự định đi thăm An Giang, Gia Lai và Kon Tum của đoàn
không may đã bị gián đoạn từ ngày 28 đến 30/7. Tôi nhận được những thông tin
đáng tin cậy là một số cá nhân tôi muốn gặp đã bị đặt dưới sự theo dõi chặt
chẽ, cảnh cáo, đe dọa, sách nhiễu hoặc bị công an ngăn cản việc đi lại. Ngay
cả những người đã gặp được tôi cũng không tránh khỏi việc bị công an theo dõi
hoặc chấn vấn ở một mức độ nhất định. Ngoài ra, việc di chuyển của tôi cũng
bị giám sát chặt bởi "Những cán bộ an ninh hoặc công an" mà chúng
tôi không được thông báo rõ, đồng thời sự riêng tư và bảo mật của một số cuộc
gặp gỡ cũng bị ảnh hưởng. Những việc này là sự vi phạm rõ ràng các điều khoản
tham chiếu của bất kỳ chuyến thăm quốc gia nào."
Dân tộc Việt Nam đang ở khúc quanh quyết định của những chuyển biến cần thiết
trong chính sách đối ngoại và đối nội nhằm đoàn kết, ổn định lòng dân, tranh
thủ được hỗ trợ của quốc tế để vượt qua những khó khăn về kinh tế và an ninh
biển đảo. Nhưng những động thái của chính quyền qua hai sự kiện trên thực sự
đã gây nhiều thất vọng.
Rõ ràng việc ra sức ngăn chặn công dân Việt Nam tham gia những hoạt động hội
thảo và trao đổi về Quyền Con Người này không những không giúp cho chính phủ
Việt Nam cải thiện hình ảnh của mình trước con mắt quốc tế, mà ngược lại càng
khiến cho người ta thấy những cáo buộc vi phạm nhân quyền dành cho Việt Nam
từ trước tới nay là có cơ sở. Chỉ có sự chân thành và nỗ lực cải thiện nhân
quyền thực sự mới giúp cho chính quyền lấy lại lòng tin vào lúc này.
Trước sự việc này, Con Đường Việt Nam tuyên bố:
Chúng tôi cực lực phản đối các hành xử tiêu cực, bội tín, thiếu minh bạch, tước
đoạt các quyền con người cơ bản của công dân mình của các cấp chính quyền
Việt Nam.
Các hành vi này rõ ràng xem thường luật pháp, chà đạp lên chính hiến pháp
Việt Nam, phản bội những cam kết đã ký với quốc tế, không xứng đáng là một
thành viên có trách nhiệm của LHQ, đặc biệt với tư cách là một trong 47 quốc
gia thành viên Hội đồng Nhân quyền LHQ nhiệm kỳ 2014-2016 có sứ mạng thúc đẩy
và bảo vệ nhân quyền trên thế giới.
Chúng tôi yêu cầu chính quyền Việt Nam lập tức chấm dứt tất các hình thức sách
nhiễu lập đi lập lại này trong nhiều năm qua, hãy đối thoại với công dân mình
ngay cả những ý kiến khác biệt chứ không phải chỉ hành xử tuỳ tiện bịt miệng
bằng cách bắt bớ và bỏ tù vô cớ vốn chỉ mang lại những kết quả hạn chế tiêu
cực trước mắt nhưng xói mòn niềm tin của người dân vào luật pháp và tự đặt
mình vào vị trí thiếu chính danh.
Chúng tôi kêu gọi các công dân Việt Nam khác không sợ hãi trước những bức hại,
tiếp tục mạnh dạn hành xử quyền con người của mình trong tư cách là công dân
một nước thành viên LHQ có trách nhiệm chia sẻ, bảo vệ các quyền con người
phổ quát và thiêng liêng của nhân loại tiến bộ.

Press
release on the issue of the Vietnamese government
prevented
its citizens from attending discussions on Human Rights.
On June 20, 2014, at the
meeting of the UN Human Rights Council in Geneva
which concludes the Vietnam's
Universal Periodic Review (UPR) process, the government of Vietnam
accepted 182 of the 227 recommendations from other countries. Among
those recommendations that have been accepted by Vietnam was one that made by
Australia, which states: ắGive space to non-state media, and that make
Criminal Code Articles 79, 88 and 258 more specific and consistent with
international human rights obligations on freedom of expression.ă
In response, the Australian
government and the European Union, the embassies of Canada, New
Zealand, Norway,
and Switzerland have
jointly organized the seminar: Non-state media in Vietnam
right now on July 30, 2014 at the Embassy of Australia in Hanoi, Vietnam.
During this same time, the UN's
Special Rapporteur on Freedom of Religion or Belief, Heiner Bielefeldt, was
invited by the Government of the Socialist Republic of Viet Nam to conduct a
country visit from July 21, 2014 to July 31, 2013. The purpose of the country
visit was to study more about the protection and support of the people's
freedom of religion or belief and if there were any obstacles to these basic
rights in Vietnam.
Both of the above-listed events
were open to the public, and they offered an opportunity for the Government
of the Socialist Republic of Viet Nam to prove to the international community
that Vietnam readily accept the responsibilities and commitments of a member
of the Human Rights Council.
However, instead of providing
an accessible environment as it has officially promised the other countries,
the Vietnamese government once again used tactics to surround, harass,
threaten, and arbitrary restraint in order to prevent and isolated Vietnamese
citizens from participating in these events. Specifically, the
following bloggers, independent reporters, and other civil dissidents, Dr.
Nguyen Dan Que; former prisoner of conscience, Pham Ba Hai; Mrs. Duong Thi
Tan; Mr. Pham Chi Dung, Pastor Nguyen Manh Hung; Pastor Nguyen Hoang Hoa;
Chairman of the Hoa Hao Buddhism, Le Quang Liem; Ms. Nguyen Ngoc Nhu Quynh;
Ms. Tran Thi Nga; Ms. Huynh Phuong Ngoc; Ms. Pham Thanh Nghien, etc. were
being harassed by the government before and after their participation in
these events.
In his press statement on the
visit to the Socialist Republic of Vietnam issued on July 31, 2014, Mr.
Heiner Bielefeldt stated: ắThe planned visits to An Giang, Gia Lai and Kon
Tum provinces were unfortunately interrupted from 28 to 30 July. I received
credible information that some individuals whom I wanted to meet with had
been either under heavy surveillance, warned, intimidated, harassed or
prevented from travelling by the police. Even those who successfully met with
me were not free from a certain degree of police surveillance or questioning.
Moreover, I was closely monitored of my whereabouts by undeclared ắsecurity
or police agentsă, while the privacy and confidentiality of some meetings
could have been compromised. All these incidents are in clear violation of
the terms of reference of any country visit.ă
Vietnam is at a historical crossroad where appropriate
decisions are necessary in both its foreign policy as well as internal policy
making to unite and reassure its people and to receive international support
to overcome the current crisis of the economy as well as the national
security in regard to its seawaters. The government's action in the two
above-referenced events has truly disappointed the public.
Clearly, the determination to
prevent Vietnamese citizens from participating in these seminars and
discussions in regard to Human Rights not only does not help the Vietnamese
government improves its image in the international community. Quite the
contrary, it allows everyone to believe that the allegations of human rights
violations in Vietnam
have now been substantiated. Therefore, only a sincere effort to
realistically improve human rights conditions would be able to help the
government to gain its people trust at this time.
Being confronted with these
events, the Vietnam Path Movement announces:
We strongly object the
negative, untrustworthy, and nontransparent tactics utilized by the
Vietnamese government at every single level to infringe upon the basic human
rights of its citizens. Such conducts clearly disregard the law,
violate Vietnam's own constitution, go against all the international treaties
Vietnam has ratified and approved, and they are not the conducts of a
responsible member of the United Nations, especially a member of its Human
Rights Council's 47 states for the term of 2014-2016 who has the duty of
promoting and protect human rights in the world.
We demand that the Vietnamese
government immediately cease all of its repeating harassment in all forms
which has been used by them against its people over the years and instead
begin to hold dialogues with citizens even with the dissidents, and not to
act arbitrarily to silence them by arrest and imprisonment without cause
which only brings immediate, negative and limited consequences, causing its
people to lose faith in the judicial system and to put the government in a
position that lacks authority.
We call on all Vietnamese
citizens to lay down their fear when confronted with oppression and continue
to exercise their human rights with courage and as the people of a member
state of the United Nations' Human Rights Council that has the responsibility
to share and protect the sacred and universal human rights of the progressive
humankind.
